GENERAL TERMS AND CONDITIONS

1. CONCLUSION OF CONTRACT

The depiction of the products in the online shop is not a legally binding offer but a non-binding online catalogue.
Before sending your order, you have the opportunity, in the step “Check and confirm order”, to once more check and, if necessary, change all entered specifications (e.g., name, address, method of payment, and ordered article).
By clicking the order button you send a legally binding order of the articles in the shopping cart. The receipt of the order is confirmed together with the acceptance of the order immediately after sending by an automated e-mail.
If you opt for payment in advance as the method of payment, you will subsequently receive our voucher with the bank transfer specifications. The contract is concluded upon sending the voucher via e-mail.
Except if you have opted for PayPal as the method of payment. Then the contract is in any case concluded when the payment order is confirmed at the payment service provider. In this case you will also receive the voucher automatically when the payment transaction is completed.

The precondition of an effective conclusion of contract is always that the order is completed by sending the order.

3. METHODS OF PAYMENT
Payment is carried out either through payment in advance or via PayPal.
PAYMENT IN ADVANCE / When opting for payment in advance, we shall indicate our bank account on the invoice form and deliver the article upon receipt of payment.
PayPal / You pay the invoice sum via the online provider PayPal. You must be registered there or register first. After legitimization with the access data, you can confirm the payment order to us. You will receive further information during the order procedure.
If you opt for PAYMENT IN ADVANCE but would like to pay with your credit card, please contact us directly. You can reach our delivery office from Tuesday to Friday between 11 am and 4 pm under +49 30 20 20 93 15.
4. DELIVERY AND SHIPPING COSTS

We deliver with different contract partners, but inside Germany usually with GLS.
Delivery takes place after our accounting department has controlled the receipt of payment and on two delivery days per week. In the most unfavorable case, delivery time can take ca. 7 workdays after the receipt of payment has been confirmed.
We collaborate with small labels and our program includes many small series and unique pieces. In rare cases, it can occur that an article offered in the online shop is no longer available. If you want to pay in advance, you will then receive a corresponding message instead of the invoice. The sales transaction will not be concluded. If you use PayPal, you will promptly receive your money back.
Please always inform us directly if you require the delivery on a certain date or within a certain period of time. We shall then handle such deliveries preferentially.
You can reach our delivery team under +49 30 85 40 55 07 from Monday to Friday between 10 am and 6 pm.

In addition to the indicated product prices there are shipping costs. Information on the amount of shipping costs is given with the offers or in the shipping cost calculator.
IN GERMANY / For deliveries within Germany we charge a percentage of the shipping cost of at least 6.90 euros. The calculation of Shipping Cost is determined on the basis of volume and weight of the order.

Exempt from these regulations is the transport of art or unique pieces. In these cases we shall agree upon an individual transport solution with you.
ABROAD / For deliveries outside of Germany we also charge the accrued transport costs. In these case, too, we shall also find individual transport solutions for artworks and unique pieces.

5. TRANSPORT DAMAGES
If articles are delivered with obvious transport damages, please immediately complain about this to the shipper and contact us. Failing to complain or to make contact has no consequences for you legal claims and their assertion, especially your warranty rights. But you do help us in validating our own claims to the shipper and the transport insurance company.

6. RIGHT OF CANCELLATION
You can cancel your contract in written form (e.g., letter, fax, e-mail) within 14 days without giving a reason or – if you receive the article before the time limit – by sending it back. The period of time starts after receiving these instructions in written form, but not before the article has been delivered to the recipient (or, in case of recurring shipments of the same article, not before the first partial shipment) and also not before fulfilling our obligation to inform according to Article 246 § 2 in conjunction with § 1 Par. 1 and 2 EGBGB, as well as our duties according to § 312g Par. 1 Line 1 BGB in conjunction with Article 246 § 3 EGBGB.
To meet the cancellation time limit, it suffices to send the cancellation or the article in due time. Cancellation must be sent to:

CONSEQUENCES OF CANCELLATION
In case of an effective cancellation, the performances received by both sides must be returned and, if applicable, gained benefits (e.g., interest) reimbursed.
If you cannot return the received performance or benefits (e.g., advantage of use) or only partially or in an impaired condition, you must give us compensation for lost value. You must only give compensation for lost value in case of an impairment of the article or gained benefits, to the extent that the uses or the impairment results from handling the article in a way going beyond checking its features and function.
”Checking the features and function” is understood as testing and trying out the respective article as it is possible and customary in a store.
Articles eligible for shipping are to be returned at our risk. You must bear the regular costs of the return shipment, if the delivered article complies with the ordered one and if the price of the article to be returned is no higher than 40 euros or if, in case the price is higher, you have not yet rendered a service in return or made a contractually agreed partial payment. In other cases the return shipment is free of charge for you. Your time limit begins upon sending us your declaration of cancellation or the article, ours begins with the receipt of the cancellation or the article.

7. COSTS WHEN MAKING USE OF THE CANCELLATION
We make use of the possibility to pass on the costs for the return shipment to you within the frame of the legal right of cancellation in the instructions above as follows: You have to bear the regular costs of the return shipment if the delivered article complies with the ordered one and if the price of the article to be returned is no higher than 40 euros or, if the price of the article is higher, no service in return or a contractually agreed partial payment has been made at the time of cancellation.

8. MINIMUM ORDER VALUE
Your order is not subject to a minimum order value. Please note, however, that for each shipment costs of at least 6.80 euros accrue. (see above)

9. WARRANTY
Warranty is given according to the legal stipulations. In case of any kind of defects occurring during the legal warranty period of two years after delivery, you have the legal right to remedy of defects or a new shipment or reduction or cancellation.

10. DATA PRIVACY
To process your order, we store your address and personal data. Your data are passed on to the shipping company commissioned with the shipment as far as this is necessary to deliver the article. To carry out payments, we pass on your data to our house bank if required.
The client has been informed in detail of the type, scope, location and purpose of collecting, processing and using the personal data required for carrying out orders as well as of his right of objection to using his anonymized user profile for advertising purposes, market research and to tailor the design of the service.
The client expressly consents to the collection, processing and use of his personal data. He has the right to revoke this consent at any time and with immediate effect.
This website uses Piwik, a web analytics open-source software. Piwik uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address anonymized prior to its storage) will be stored on the server of the service provider in Germany. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website.

11. OTHER RIGHTS
Our offer is without obligation.
The contracts of sale concluded with us are in all cases subject to German law, also in case of a cross-border context, i.e., orders from and/or shipments to foreign countries.
The provisions of the UN Sales Convention are not applicable.

12. RETENTION OF TITLE
Until the entire payment has been made, the delivered article remains our property.
